Ecobike Warranty

Ecobike North America, Inc. warrants to the original purchaser of each new electric bicycle, sold through an authorized dealership, that the following components will be free from defects in material and workmanship for the period indicated.

5 Years (60months): The bicycle frame, except the fork, for the original owner/purchaser.
1 Year (12months): Original Li-ion battery, considering natural depletion rate of 10% per year, and battery must be maintained as per the instruction manual. All original parts and components, for the original owner/purchaser.

Ecobike North America, Inc. further warrants that any repair or replacement parts supplied will be free from defects in material and workmanship for a period of one year from the date of purchase.

This warranty is non-transferable and is only valid under the following conditions:

• Assembly was carried out in the manner described in this manual.
• The bicycle has been operated according to the instructions listed in this manual.
• All warnings and precautions have been read and followed according to this manual.
• A valid receipt has been provided prior to or when the claim has been filed.
• Warranty card has been filled out and returned upon purchase.
• Ecobike North America must be contacted and approved before returning any item.

This warranty does not cover:

• Normal wear and tear
• Improper assembly
• Improper follow-up maintenance
• Installation of parts or accessories not originally intended for, or compatible with, the bicycle as sold
• Damage or failure due to accident, misuse, abuse, or neglect
• Labor charges for part replacement or changeover

This warranty is void in its entirety by any modification of the frame, fork, or components. This warranty is expressly limited to the repair or replacement of a defective item and is the sole remedy of the warranty. This warranty extends from the date of purchase, applies only to the original owner, and is not transferable. Ecobike North America, Inc. is not responsible for incidental or consequential damages. Some states do not allow the exclusion of incidental or consequential damages, so the above exclusion may not apply to you. Claims under this warranty must be made through an authorized Ecobike dealer.

Proof of purchase is required. The subject item must be registered with Ecobike North America, either through on-line registration or by the receipt of a warranty registration card by Ecobike North America, Inc., before a warranty claim may be processed. Warranty duration and detail may differ by frame type and/or by country. This warranty gives the consumer specific legal rights, and those rights may vary from place to place. This warranty does not affect the statutory rights of the consumer.

REQUIRED ASSEMBLY WHEN PURCHASED
An authorized Ecobike dealer will assemble your new Ecobike electric bike, without charge, at the time of purchase or if shipped, gets the bike prepped and packaged,( i.e. pre-assembled except for the turning and tightening of the handle bar stem, seat and pedals). The folding electric bikes are shipped ready to ride after removing packaging and unfolding. To assure safety and activate warranty the customer is however REQUIRED to bring the assembled bike (within 10 days) to a local to bike shop for a safety check and show proof hereof.

LIMITED LIABILITY
Unless otherwise provided, the sole remedy under the above warranty or any implied warranty, is limited to the replacement of defective components and parts with those of equal or greater value at the sole discretion of Ecobike North America, Inc. THE CUSTOMER WILL BE RESPONSIBLE FOR LABOR COSTS ASSOCIATED WITH WARRANTY REPLACEMENTS. IN NO EVENT SHALL ECOBIKE NORTH AMERICA, INC. NOR SBEBC,INC. BE RESPONSIBLE FOR DIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR PERSONAL INJURY, PROPERTY DAMAGE, OR ECONOMIC LOSSES, WHETHER BASED ON CONTRACT, WARRANTY, NEGLIGENCE, PRODUCT LIABILITY, OR ANY OTHER THEORY. Some states do not allow the exclusion or limitation of damages, so the above limitation or exclusion may not apply.

EXCLUSIONS
THE ABOVE WARRANTY, OR ANY IMPLIED WARRANTY, DOES NOT COVER NORMAL WEAR AND TEAR. ALL WARRANTIES ARE VOID IF THE ELECTRIC BIKE IS USED FOR OTHER THAN NORMAL ACTIVITIES, INCLUDING, BUT NOT LIMITED TO, FAILING TO FOLLOW THE OWNER'S MANUAL OR USING THE ELECTRIC VEHICLE FOR COMMERCIAL ACTIVITIES OR IN COMPETITIVE EVENTS, AND TRAINING FOR SUCH ACTIVITIES OR EVENTS. ECOBIKE NORTH AMERICA, INC. MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED. ALL IMPLIED WARRANTIES, INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO THAT OF THE EXPRESS WARRANTIES STATED ABOVE.

Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
